LIVE UPDATES: FHSAA unanimously approves NIL; Open Division playoff bracket approved with delayed implementation in 2026-2027 school year

GAINESVILLE, Fla. — The Florida High School Athletic Association (FHSAA) and their Board of Directors will be conducting the final meeting of the 2023-2024 school year today with Name, Image and Likeness (NIL) policies on the docket as well as a vote on an Open Division playoff bracket that could be applied to all team sports.

11:27 AM ET

The FHSAA BOD meeting for June of the 2023-2024 school year has been adjourned. Stay tuned to FloridaHSFootball.com for more a complete story along with quotes and videos regarding today’s votes and decisions from today’s meeting


11:12 AM ET

The FHSAA BOD has approved 2024-2025 School Year Meeting Dates for the Board of Directors, PLAC, Sectional Appeals Committees, and the 28th Representative Assembly. We are now in to the reports of the Executive Director, Report of the Board President, and Board of Directors Comments and Requests. Meeting is near the end and is much shorter than we thought it could have been today.


10:58 AM ET – OPEN DIVISION VOTE

The Open Division playoff bracket has been approved unanimously by the FHSAA BOD with an amendment that it would not be implemented until the 2026-2027 school year.


10:56 AM ET

The motion on the floor is being amended which would mean the Open Division playoff bracket would not start until the 2026-2027 school year.


10:53 AM ET

A motion is on the floor for an Open Division championship bracket. There are questions about the timing of this and being prepared about the plan.


10:46 AM ET

We are now at the agenda item about the Open Division Championship Division bracket. Discussion is happening. Not sure if they are going to postpone this vote and bring it back for discussion next school year or not.


10:44 AM ET

FHSAA BOD has approved unanimously Policy 20 for Football in regards to padded contact camps to be hosted by third-parties which would also allow camps to be held on an FHSAA members school campus with teams following the policies regarding acclimation and how many teams can be a part of a camp. The FHSAA BOD also has approved the expanded use of a shot clock in basketball contests to include the FHSAA State Series if both schools agree while in the regular season the use of the shot clock must be noted and signed by both schools on the game contract.

Motion carries unanimously by the FHSAA BOD for policy changes that relate to the Zachary Martin Act in Policies 41-43.


10:23 AM ET

FHSAA BOD meeting is now moving into the report of the Operations Committee which discuss a variety of policy proposals including one regarding Policy 20 in Football for Padded contact camps to be hosted by a third-party.


10:19 AM ET – NIL VOTE

NIL: FHSAA BOD has unanimously approved the NIL language which makes Florida the 36th state to adopt NIL language for high school athletics.


10:08 AM ET

BOD President Monica Colucci says that the proposed language is a good start and states about the discussions that started back in February and all the meetings and workshops that have been held up to this point in addressing various concerns.


10:06 AM ET

Trevor Berryhill is a proponent of bigger penalties for transfers for NIL in recruiting. Berryhill also mentioned that things will be hard to control with NIL.


10:04 AM ET

The Master’s Academy (Oviedo) AD Trevor Berryhill who is also on the BOD says that the language does include Booster Club which is more stated as an “athletic booster organization.”

BOD Paul Selvidio is afraid that the FHSAA could penalized a Booster Club because he feels the language of what is an NIL Collective is not being made clear. Selvidio says we are banning the word collective without more clarity.


9:58 AM ET

BOD Paul Selvidio now asking what is the difference between a booster club and NIL collective which there are difference. Booster Clubs support whole programs including one or multiple sport teams. Collective means a group of individuals or businesses which would individually support selected athletes.


9:52 AM ET

BOD Paul Selvidio is asking a question regarding about NIL Collectives which would be under prohibited NIL engagements in the proposal. Questions surrounds about businesses, and other individuals that want to support schools and engage with athletes directly. There is an also a fourth page that is a part of this I forgot to include in the last update.

Crews says NIL is unregulated in the NCAA, and now Florida is looking at jumping into it. Says it is a scary time. Crews is not fully in support of the NIL. Says there are some pitfalls and has placed three or four articles on their desks regarding the issues going on with NIL in college athletics. Crews also expressed that the educational piece is needed.

Shelton Crews of the Florida Athletic Coaches Association is the first public speaker up in regards to NIL.


9:31 AM ET

The FHSAA Board of Directors is about to discuss Bylaw 9.9 Proposal NIL. We will post updates in real time here as the Board of Directors discusses the matter as Florida could become the 36th state to approve Name, Image and Likeness policies for high school athletes.


9:19 AM ET

The BOD is about to move into the Report of the Governance Committee where a lot of membership election and re-election to membership is taking place. This is for all of the association and this portion of the meeting will take a few minutes to go through. After the items are approved regarding membership, we will be arriving at the NIL proposal that will be voted upon by the BOD today.

FHSAA Land Corporation portion of the meeting now taking place.


9:14 AM ET

BOD member Paul Selvidio mentions that FHSAA Executive Director is working on replacing the TV contract revenue that was loss that happened when the Spectrum deal came to an end after the 2022-2023 school year.


9:10 AM ET

Motion carriers unanimously on the financial statements ending for the period of April 30, 2024. Brandi Waters, FHSAA Associate Executive Director is now presenting the tentative budget for the 2024-2025 school year. FHSAA is projected to have a loss over $680,000 for the 2024-2025 school year which increase number of classifications, and a pay raise for officials is coming up next school year.


9:07 AM ET

Report of the finance committee now taking place with the FHSAA reporting that they are operating with 103% of their projected revenues for the 2023-2024 school year.


9:05 AM ET

Agenda approved unanimously to move forward with the meeting along with the minutes being approved from the previous meeting.


9:02 AM ET

Meeting is underway here in Gainesville with introductions of guest and Board of Directors roll call has taking place.
